For most people, buying or selling a property is the most significant and financially demanding transaction of their lives. At the same time, there are numerous legal challenges and a large number of parties need to be involved before the property can be transferred in the land register.
A notary guarantees professional advice, the legally correct drafting of the contract and the reliable execution of the purchase agreement. This is why the law stipulates the involvement of a notary in real estate transactions.
All notary fees are standardized throughout Germany and are regulated by the Court and Notary Fees Act. So you pay the same for every notary. The costs of buying or selling a property depend on the purchase price. Large transactions have higher fees than small transactions, which makes the fee system particularly socially acceptable. You contact us and provide us with the information required to draw up the draft contract. If we have any queries, we will contact you. We then inspect the land register and draw up a draft contract that takes into account the interests of all parties involved: The seller only wants to lose his property if it is certain that he will receive the purchase price. The buyer wants to be sure of becoming the owner before payment.
We will send you the draft of the certificate so that you can read through it at your leisure. We will then clarify any open questions and you can inform us of any changes you wish to make.
The next step is the notarization of the contract, during which the notary reads out the contract and explains the agreements in more detail. All parties can of course ask questions during the notarization if they would like more detailed explanations. Once the document has been read out in full and all parties are in agreement, the contract is signed by them and the notary. The actual notarization is now complete!
The notary then arranges for the deed to be processed. This step includes communication with authorities, courts and banks as well as, for example, the entry of reservations or the obtaining of deletion documents. The notary informs the parties involved when all requirements for the purchase price due date have been met. As soon as the buyer has made the payment, the notary works towards the transfer in the land register. The purchase contract is completed as soon as the new owner has been entered in the land register. Of course, we will continue to be there for you as a contact partner even after the contract has been completed. Depending on the type of property involved, there may be minor deviations in the process. However, these will of course be discussed with you in advance so that you always feel fully informed and informed.
A land charge secures a (loan) liability. Banks only grant financing if they receive appropriate security for repayment. The bank can use a land charge to foreclose on the property if the loan is not repaid.
